Development Clawback

Lots 2 and 3 will be sold subject to a residential and commercial development clawback stating that the vendors, or their heirs, will be entitled to 30% of the increase in value if residential or commercial planning permission is granted on the land within 25 years.

Basic Payment Scheme

The land is registered under the Basic Payment Scheme. The seller reserves the payment for the 2018 claim year.

If required by the buyer the relevant entitlements will be included free within the sale, subject to RPA rules.

Rights of Way & Easements

The property is sold subject to and with the benefit of all rights including rights of way, whether public or private, light, support, drainage, water, telephone and electricity supplies and other rights and obligations, easements, quasi-easements and restrictive covenants, and all existing and proposed wayleaves or masts, pylons, stays, cable, drains and water, gas or other pipes, whether referred to in the Sales Particulars or not, and to the provisions of any Planning Scheme or County or Local Authorities without obligations on the part of the Sellers or their agents to specify them.

Access to Lots 1 and 2 is gained via an un-adopted lane leading from Wesleyan Road. 100 Gravelly Hill has the benefit of a right of way over the eastern corner of lot 2 to pass from their garden to the track. Lot 4 has the benefit of a shared access over the council owned gravel yard and a private access from Gravelly Hill.

For sale by PUBLIC AUCTION on Thursday 7th June 2018 7pm prompt at  Grazer’s Café, Market Drayton Livestock Market, Market Drayton, TF9 3SW.

The sale will be subject to a reserve price and the Vendors reserve the right to sell the property prior to Auction or to withdraw the property from sale without explanation or notice to interested parties.

Contracts and Conditions of Sale

The contracts and conditions of sale in respect of the property will be available for inspection ten days prior to the sale at either the Market Drayton office of the Agents or at the office of the Vendors’ Solicitors.  They will not be read out at the sale and the purchasers will be deemed to buy with full knowledge thereof.

Directions

From Market Drayton follow the A53 north through Loggerheads. After leaving Loggerheads take the first right hand turn for Ashley. Follow this lane for 0.2 mile and Ashley Memorial Hall will be found on the left hand side. We would advise parking in the car park and walking to inspect the land via the footpath at the north end of the car park or Gravelly Hill.
